Merchant Obligations:
• The merchant is obliged to deliver goods to the consumer that comply with the terms stipulated in the contract.
• Goods are considered in conformity with the contract if they match the description provided by the merchant and possess the same qualities as any sample presented to the consumer.
• In the absence of a description provided by the merchant, goods are considered in conformity with the contract if they are fit for the specific purpose the consumer made known to the merchant at the time of concluding the contract, and which the merchant accepted.
Legal Warranty:
•If the goods are found to be defective, the consumer has the right to demand that the merchant remedy the defect (repair or replace the goods free of charge, or reduce the price) or to withdraw from the contract.
• Repair and replacement are the consumer’s primary rights. The consumer may demand free repair or replacement unless the nature of the goods makes this impossible, or it requires disproportionate or unreasonably high costs.
•Goods must be repaired or replaced within a reasonable timeframe (Replacement: no later than 10 calendar days from the discovery of the defect; Standard Repair: no later than 30 calendar days from the discovery of the defect), without causing significant inconvenience to the consumer, taking into account the nature of the goods and the purpose for which they were purchased.
• Free repair or replacement means the merchant covers all necessary costs (including postage, labor, and materials) to bring the goods into conformity with the contract.
•The consumer has the right to demand a price reduction or withdraw from the contract under any of the following conditions:
•Repair or replacement of the goods is impossible.
•The merchant failed to repair or replace the goods within a reasonable time, and the consumer has lost interest in the performance of the contract.
•Repair or replacement by the merchant would cause significant inconvenience to the consumer.
• In case of withdrawal from the contract, the consumer has the right to claim compensation for damages caused by the non-performance of the contract, in accordance with the rule established by Georgian legislation.
• The consumer does not have the right to withdraw from the contract if the defect in the goods is minor.
• The consumer may exercise the aforementioned rights if the defect is discovered within 2 years after the goods are transferred to them.
• If the consumer discovers a defect within 6 months of taking possession of the goods, it is presumed, until proven otherwise, that the defect existed at the time of delivery, provided this is compatible with the nature of the goods or the defect. In this case, the burden of proof lies with the merchant. If the defect is discovered after 6 months, the burden of proof that the defect existed at the time of delivery shifts to the consumer.
Order Acceptance
•Consumers can purchase items via bank transfer. Cash on delivery (paying the courier upon receipt) is also available.
•The merchant is obligated to process the order within a maximum of two days from the moment the funds are credited to the bank account. Delivery to the consumer should not exceed 1-5 working days from order processing. Due to high volume during sales and holidays, this timeframe may be extended to 10-12 working days.
• An order is considered complete as soon as the item is handed over to the consumer.
• If delivery to the consumer is impossible, the order will be canceled, and the paid amount will be refunded.
• Upon receipt of the order, the consumer is obliged to inspect it and confirm with a signature that the item has no visual defects.
• The merchant is obliged to provide the customer with all documents related to the order upon request.
Delivery Fees
•Delivery in Tbilisi: 5 GEL (Free for purchases over 100 GEL)
•Express Delivery in Tbilisi: 15 GEL
•Delivery in Regions: 10 GEL (Free for purchases over 200 GEL)
Unconditional Return Policy
•The consumer has the right to withdraw from a distance contract and/or an off-premises contract within 14 calendar days without specifying any reason.
This period is calculated from:
•For service contracts: the date of contract conclusion.
•For sales contracts: the moment the consumer or a third party designated by them (other than the carrier) takes possession of the goods.
•For orders delivered in parts: the moment the consumer or a third party designated by them (other than the carrier) takes possession of the last item.
•For contracts of regular delivery of goods: the moment the consumer or a third party designated by them (other than the carrier) first takes possession of the goods.
Return Conditions
•To exercise the right of unconditional return, the consumer must fill out the Return Form (see below) and send it to the following email: [email protected]
• In case of withdrawal from the contract, the consumer is obliged to:
• Return the goods to the merchant or a designated third party immediately after sending the withdrawal notice, but no later than 7 calendar days.
• Bear the direct costs associated with returning the goods.
• If the item’s features do not match the data specified on the website, the item has an original defect, or it was damaged during transportation, the merchant will cover the return of the products using its own resources.
• The consumer is obliged to return the item in full, along with all accompanying documents.
• The merchant is obliged to refund the amount paid by the consumer within 14 calendar days of receiving the return notice. The merchant has the right to withhold the refund until the goods have been received back, or until the consumer has supplied evidence of having sent back the goods, whichever is earlier.
• The refund will be processed using the same payment method used by the consumer unless the consumer expressly agrees to a different payment method.
• The consumer’s withdrawal from a distance contract automatically terminates any related contracts and restores the original pre-contractual state.
• Withdrawal from the contract releases the parties from their obligations under the distance contract, and whatever the parties received through its execution must be returned.
Exceptions to Unconditional Returns
•The delivered goods are perishable or have a short shelf life.
• The consumer received hermetically sealed goods, the seal was broken after delivery, and the goods cannot be returned due to health or hygiene standards.
• The consumer does not have the right to refuse goods or services if the price does not exceed 30 GEL.
Force Majeure
•Neither party shall be held liable for full or partial failure to fulfill obligations if such failure is caused by natural disasters, technological catastrophes, fire, acts of war, or government decisions, provided these events began or developed after the order was placed.
•If any of these circumstances directly affect the execution time defined by these Terms and Conditions, the timeframe will be extended for the duration of the force majeure event.
•The party experiencing a force majeure event must notify the other party about the circumstance, its possible duration, and its cessation.
•The facts stated in the notification must be confirmed by a competent authority (e.g., Chamber of Commerce or Industry) of the respective region.
•Failure to notify or delayed notification deprives the party of the right to use force majeure as grounds for exemption from liability.
